Reading on The Enquirer website, it seems that the FBI asked Kim Dotcom to hold pirated material on their servers while they investigate, which megaupload did. They didn't want to tamper with the evidence that the FBI needed to prosecute someone.
2 years later, the FBI used the same files they requested to be kept, to authorise a warrant.
